A Montenegro Court Has Revoked Do Kwon’s Extradition Permission

The Appellate Court of Montenegro has overruled the High Court’s ruling from November 17th, dismissed the appeal filed by the defense lawyers for Terraform Labs co-founder Do Kwon, and revoked the authorization of his extradition.

According to a statement, the Appeals Court identified problems with the legal system, specifically the High Court’s decision’s ambiguous facts and reasoning.

The court stated that there were procedural problems in the way the investigating judge handled the U.S. extradition request, even if the South Korean request appears to have been handled lawfully, with Do Kwon consenting to an accelerated extradition procedure.

It specifically claimed that the judge had not invited Do Kwon to offer his defense as required by law, nor had he appropriately informed him of the justifications and supporting documentation for the U.S. request. For a retrial, the case has now been brought back to the original court.

After serving a 4-month prison sentence in Montenegro for document forgery, Do Kwon was earlier granted extradition to one of the countries by the High Court in Podgorica, the capital city of Montenegro. The ultimate determination of which nation was more important was expected to come from Montenegro’s Minister of Justice.

Due to allegations of financial crimes in the United States and South Korea resulting from the multibillion dollar collapse of the Terra ecosystem in May 2022, Do Kwon’s extradition had been requested.
